Terms & Conditions

1. Acceptance of Terms

By accessing and using ThinkLab's services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. These terms constitute a legally binding agreement between you ("Client") and ThinkLab, Lda. ("ThinkLab", "we", "us", "our").

2. Intellectual Property Rights

Upon full payment for our services, the final video deliverables become the property of the Client. ThinkLab retains a limited, non-commercial license to:

  • Display the video in our portfolio
  • Use the video for promotional purposes
  • Share the video on our social media platforms and website

ThinkLab explicitly agrees not to use the delivered videos for any commercial purposes or monetary gain without the Client's written consent. This includes, but is not limited to, selling, licensing, or monetizing the content in any way.

3. Client Content Responsibilities

The Client warrants and represents that:

  • They own or have properly licensed all images, photographs, and other content provided to ThinkLab for video production
  • They have obtained all necessary permissions, releases, and authorizations from any individuals appearing in the provided content
  • The use of provided content does not infringe upon any third party's rights, including but not limited to copyright, trademark, privacy, or publicity rights

The Client agrees to indemnify and hold ThinkLab harmless from any claims, damages, or expenses arising from the use of content provided by the Client that violates third-party rights or applicable laws.

4. Image and Likeness Rights

For any content containing identifiable individuals, the Client must ensure and certify that:

  • Written consent has been obtained from all identifiable individuals appearing in the provided content
  • The consent explicitly permits the use of their image and likeness in videos produced by ThinkLab
  • Any special restrictions or limitations on the use of their image have been clearly communicated to ThinkLab in writing

ThinkLab reserves the right to request proof of such authorizations and may refuse to use content where adequate permissions cannot be verified.

5. Service Delivery

ThinkLab commits to delivering high-quality video content according to agreed-upon specifications and timelines. The Client will have the opportunity to request revisions as specified in the service agreement. Final delivery is subject to complete payment of all agreed fees.

6. Payment Terms

Payment terms and schedules will be specified in the service agreement. Transfer of ownership rights for delivered videos is contingent upon full payment of all invoices. Late payments may result in delayed delivery or service suspension.

7. Limitation of Liability

ThinkLab's liability shall be limited to the amount paid for the services. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

8. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after such modifications constitutes acceptance of the updated terms.
